Be Realistic in Property Advertisements: RERA Warns Real Estate Builders Against Misleading Buyers

The Indian real estate market is indeed growing rapidly, especially in cities like Noida, Delhi, and other cities in major urban areas. However, with this increase comes a greater responsibility for builders and developers to ensure transparency and integrity when dealing with potential buyers. In the recent conference on real estate held in New Delhi, officials from the Real Estate Regulatory Authority (RERA) strongly urged builders to follow real-world advertising strategies and follow the guidelines that are in the Real Estate (Regulation and Development) Act, also known as RERA.

It was a clear message for the government. False advertisements, misleading promises, and insufficient information about property cannot be tolerated within the Indian real property market.

RERA Officials Stress Transparency in Real Estate Advertising

At the event, Anand Kumar, Chairman of Delhi RERA, emphasized that real estate developers should ensure that their advertisements depict the exact property and the amenities provided. According to him, disputes between builders and buyers result from advertisements that set unrealistic expectations.

He said that advertising should be accurate, honest, and supported by solid information. Builders are advised to mention all important information, like carpet area, covered area specifications, approvals, and timeframes for possession. He also advised that developers should not promote projects solely by referring to "super area," as this can lead buyers to be confused about the usable space within the property.

For a long time, consumers in India have encountered issues in which the amount of space promised by developers varied in significant ways from the actual usable space at the time of possession. RERA has now asked developers to emphasize transparency to ensure that buyers make informed decisions about investments without confusion.

Assured Return Schemes Under Scrutiny

One of the main concerns mentioned by RERA representatives was the increasing popularity of "assured return" schemes in the real property market. Numerous developers entice buyers by offering fixed monthly or annual returns on investments in property. Although these promises may seem appealing, RERA officials warned that these schemes cannot be permitted if they infringe on legal regulations or deceive buyers.

Anand Kumar clearly stated that financial incentives need to be transparent and in compliance with RERA regulations. Buyers should not be enticed into buying projects with unrealistic promises of guaranteed returns or profits.

In recent times, many investors have experienced losses because certain builders did not meet the promised return obligations following delays to projects or financial difficulties. RERA authorities believe that a more rigorous monitoring of these ads will ensure that consumers are protected from risks in the future.

Importance of Registered Agreement for Sale

Another key issue discussed during this conference is the rules about advance payments by buyers. According to RERA rules, developers are not able to receive at least 10% of the property's cost before signing a contract of sale.

This law was introduced as a crucial safeguard for buyers of homes. It guarantees buyers legal protection prior to paying a substantial amount for the construction company. RERA officials reminded builders that violating the rule could result in strict disciplinary action.

The authorities also urged buyers to know the rights they have under RERA prior to purchasing any property. The awareness among buyers is crucial for reducing conflicts and increasing trust in the real estate market.

Buyers Advised to Verify Ownership Structures

RERA officials have also expressed concern about the growing popularization of "virtual space" selling and fractional ownership models. These models of investment allow multiple buyers to hold part of residential or commercial properties. These types of investment models are getting more popular with investors, and the authorities have warned potential purchasers to verify the legal ownership structure before investing funds.

Many experts believe that buyers invest in these investments without fully knowing their rights of ownership, exit policies, or legal obligations. RERA advised investors to read every document carefully and verify that the structure of the investment is in line with legal requirements.

Uttar Pradesh RERA Highlights Positive Impact of Regulation

Sanjay R Bhoosreddy, Chairman of Uttar Pradesh RERA, also said that regulatory reforms have substantially enhanced the performance of the residential real estate industry in recent times. According to him, enforcement measures have helped increase the protection of consumers and accelerate the completion of projects.

He pointed out that the real estate market contributes around 12-13% to gross state domestic product (GSDP) from Uttar Pradesh, which is much higher than the average for the country. Transparency and oversight by the regulator have contributed to boosting the confidence of buyers in the real estate market.

Bhoosreddy stated that the number of disputes that are filed each day before the authorities has decreased dramatically over the last two years. This means that developers are becoming more observant of RERA regulations and the standards of project delivery.

Rise in Project Registrations Reflects Market Confidence

This Uttar Pradesh RERA chairman also disclosed important data on registrations for projects. According to his report, the number of approved real estate projects has grown dramatically over the past few years.

  • About 197 projects were registered by 2023.

  • Around 259 projects were approved in 2024.

  • More than 308 new projects had been approved by 2025.

The official added that registrations for this year's calendar have already surpassed 100 projects, and could reach 400 at the end of the year.

This increase is a sign of growing confidence between buyers and developers in the highly regulated real estate industry. Experts believe that more stringent regulations encourage legitimate developers and reduce fraud within the real estate sector.

Financing Challenges Remain a Major Concern

Despite the encouraging developments, RERA officials acknowledged that financing is still a major obstacle for a lot of developers. Bhoosreddy demanded that banks and financial institutions offer better-term financing for real estate firms, in particular for commercial and residential projects.

In the same vein, he cautioned developers against the risk of financial mismanagement and unnecessary delays. Projects in severe financial strain could be insolvent, which can adversely affect developers and homebuyers.

The delay of projects is one of the most significant issues in the Indian real estate market. Buyers frequently put their savings into buying homes and experience financial and emotional anxiety when the timeframe for possession is not fulfilled. Authorities believe that a responsible financial plan and more efficient project management are vital for the long-term growth of the industry.

Transparency is the Future of Indian Real Estate

The message of RERA officials was one of transparency, accountability, and protection of consumers. The Indian real estate market is becoming a more organized and controlled structure, where buyers are becoming more aware of their rights.

Developers who practice ethical business practices that provide authentic advertisements and keep their delivery dates on time will gain long-term trust and credibility in the marketplace. However, builders who rely on false advertising and false promises could be subject to more severe penalties and regulatory investigation.

As the real estate industry grows in cities such as Noida, Greater Noida, Gurugram, and Delhi, a stricter adherence to RERA guidelines is essential in creating a healthier and more secure real estate market.

Investors and homeowners, the latest caution from RERA serves as a vital reminder to always confirm the details of your project, read contracts carefully, and beware of making decisions solely on appealing ads or unrealistic returns.

The Haryana Mass Rapid Transport Corporation (HMRTC) is making significant strides in the development of the Palam Vihar to Dwarka metro extension project. Senior officials have indicated that plans are underway to finalize the alignment and locations for this much-anticipated extension, which aims to connect Palam Vihar in Gurugram to Dwarka’s Sector 21.   The project will feature key interchanges: one at the Palam Vihar station connecting with the Gurugram Metro corridor, another at the IECC station of the Airport Express, and a final interchange at the Dwarka Sector 21 metro station. The alignment for the project has been settled, but discussions are ongoing regarding the placement of the last metro station. Options under consideration include positioning the station near the Bijwasan railway station or the interstate bus terminal in Dwarka. The decision will hinge on passenger convenience and preferences for connectivity between trains and buses.   With an estimated cost of ₹1,687 crore, the project was approved by the Haryana government in October 2022. Haryana is set to cover ₹1,541 crore of this cost. Once the final alignment is decided, the project will be expedited and sent for Union government approval.   The extension will span 8.4 kilometers, with 5 kilometers running from Palam Vihar to Sector 111 in Gurugram and the remaining 3.4 kilometers extending into Delhi. The route will include seven elevated metro stations: Chauma village, Sector 110-A, Sector 111, Sector 28 in Dwarka, IECC, and Dwarka Sector 21.   The detailed project report outlines that the metro stations will be elevated, with an interchange planned at Rezangla Chowk in Palam Vihar to facilitate connections with the main Gurugram Metro line extending from Huda City Centre to Cyber City via Old Gurugram and Palam Vihar.
